Edmond Trader Funding: Terms and Conditions

These Terms and Conditions ("Terms") govern your participation in the Edmond Trader Funding Evaluation Program and, upon successful completion, your operation of an Edmond Trader Funding Performance Account. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Introduction and Definitions

1.1. Service Provider: "Edmond Trader Funding" (also referred to as "we", "us", or "our") provides evaluation programs and access to simulated trading accounts ("Services") via its website ("Site").

1.2. User Agreement: By accessing the Site or using our Services, you ("User," "Trader," "you") agree to these Terms and our Privacy Policy.

1.3. Key Terms:

  • Evaluation Account: A simulated trading account for the evaluation phase.
  • Performance Account: A simulated trading account funded by Edmond Trader Funding for Users who pass the evaluation.
  • Prohibited Conduct: Trading activities strictly forbidden as outlined herein and in the Performance Account Consistency Guidelines.

2. Eligibility and Account Registration

2.1. Age and Capacity: You must be at least 18 years old and have the legal capacity to enter into binding contracts. Services are not available to individuals in certain restricted countries and regions based on global regulations and OFAC lists. Account registration from those jurisdictions is not permitted. See our Restricted Countries and Regions page for the current list and for updates.

2.2. Accurate Information: You agree to provide accurate, current, and complete information during registration and to maintain its accuracy. You are responsible for safeguarding your account credentials and for all activities under your account.

3. Evaluation Program

3.1. Objective: The evaluation program assesses a User's trading skill and risk management according to specified objectives and rules for the chosen Evaluation Account plan.

3.2. Rules: Evaluation Account rules include, but are not limited to, profit targets, maximum drawdown limits (e.g., trailing threshold), maximum position size, and minimum trading days. Specific details are provided on the plan selection pages of the Site.

3.3. Consequences of Rule Violation: Failure to adhere to Evaluation Account rules will result in the termination of the Evaluation Account.

3.4. Advancement: Successfully passing the evaluation makes a User eligible for a Performance Account, subject to further verification, agreement to these Terms, and any applicable setup fees.

4. Performance Account

4.1. Operation: Trading on a Performance Account is subject to specific rules, including drawdown limits, and adherence to the Performance Account Consistency Guidelines, which are incorporated by reference into these Terms.

4.2. Profit Share: Profits generated in a Performance Account are subject to a profit split agreement. The standard profit share for the Trader is [e.g., 80%], after any initial thresholds are met, as detailed on our Site. Specifics may vary by plan.

4.3. Withdrawal Conditions: Payouts are subject to meeting minimum profit thresholds, minimum trading day requirements, and adherence to all rules. Withdrawal requests are typically processed [e.g., bi-weekly or monthly] via [e.g., bank transfer, Deel, or other specified methods]. Processing times may vary.

4.4. Rule Violations: Violation of Performance Account rules, including those in the Consistency Guidelines, may result in the termination of the account and forfeiture of any simulated profits not yet paid out.

5. Prohibited Trading Conduct

5.1. Engaging in Prohibited Trading Conduct on either Evaluation or Performance Accounts is strictly forbidden and will lead to immediate account termination without refund or payout. Prohibited Conduct includes, but is not limited to:

  • Using strategies that exploit the simulated nature of the accounts in ways not reflective of live market trading (e.g., latency arbitrage, server-side order manipulation if detectable and against platform terms).
  • Violating the terms of use of the connected trading platforms (e.g., Rithmic, Tradovate, NinjaTrader).
  • Unauthorized account sharing or allowing others to trade your account.
  • Specific High-Frequency Trading (HFT) strategies deemed abusive by Edmond Trader Funding.
  • Hedging positions between different Edmond Trader Funding accounts or with accounts at other firms to circumvent risk rules.

6. Fees, Payment, and Subscription

6.1. Evaluation Fees: Access to the Evaluation Program requires payment of a subscription fee as displayed on the Site for the chosen plan. This fee is typically recurring (e.g., monthly) unless cancelled or the evaluation is passed and a Performance Account is activated.

6.2. Performance Account Setup Fee: A one-time setup fee may be applicable for activating a Performance Account, as specified during the transition process.

6.3. Payment Processing: Payments are processed through third-party payment processors (e.g., Stripe). You are responsible for providing valid payment information and ensuring sufficient funds.

6.4. Subscription Renewal: Evaluation subscriptions automatically renew unless cancelled by the User prior to the renewal date through their dashboard or by contacting support@edmondtraderfunding.com.

7. Refund Policy

Due to the provision of immediate access to evaluation services, data feeds, and platform licenses upon purchase, all fees paid to Edmond Trader Funding are non-refundable. By completing your purchase, you acknowledge and agree that you forfeit any right to a refund. Please review all rules and ensure you understand the Service before purchasing.

8. Intellectual Property

The Site, Services, and all related content, features, and functionality (including but not limited to text, graphics, logos, software) are owned by Edmond Trader Funding, its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

9. Disclaimers

9.1. The Services are provided on an "as is" and "as available" basis. Edmond Trader Funding makes no warranties, express or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2. Trading futures and other financial instruments involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results. All trading within our Service occurs on simulated accounts. No real funds are traded on behalf of Users in the live market.

9.3. Edmond Trader Funding is not a broker-dealer and does not provide investment advice. Information provided is for educational and evaluative purposes only.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will Edmond Trader Funding, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site or Services, including any direct, indirect, special, incidental, consequential, or punitive damages. Our total liability to you for any claims arising from the use of the Services is limited to the amount of fees you paid to us for the Service in the preceding [Your Company Policy: e.g., three months, six months, or the total fees paid].

11. Indemnification
